Terms of Service

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a binding legal agreement governing your access to and use of the Service. By creating an account, accessing the Service, or engaging with any feature of Pirate Hunt, you affirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service immediately.

The Company reserves the right to update, amend, or replace any portion of these Terms at its discretion. Material modifications will be communicated through the Service or other reasonable means. Continued use of the Service following the effective date of revised Terms constitutes acceptance of the updated agreement.

2. Eligibility and Account Registration

2.1 Eligibility Requirements

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to access the Service. By using the Service, you represent and warrant that you meet all eligibility requirements and that your use complies with applicable laws.

2.2 Account Creation

To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information and to maintain and promptly update such information as necessary.

2.3 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You agree to notify the Company immediately of any unauthorized access, suspected breach, or compromise of your account. The Company is not liable for losses arising from unauthorized use of your credentials.

3. License and Permitted Use

3.1 Limited License

Subject to your compliance with these Terms, the Company grants you a limited, revocable, non‑exclusive, non‑transferable license to access and use the Service for personal, non‑commercial entertainment purposes.

3.2 Restrictions

You agree not to:

• modify, reverse engineer, decompile, or disassemble any part of the Service;
• circumvent, disable, or interfere with security features or access controls;
• use automated scripts, bots, or unauthorized tools to access or interact with the Service;
• exploit bugs, vulnerabilities, or unintended mechanics for personal gain;
• engage in conduct that disrupts or degrades the Service or its infrastructure;
• use the Service for unlawful, harmful, fraudulent, or abusive purposes.

Any unauthorized use terminates the license granted under these Terms.

4. Virtual Items, Credits, and Transactions

4.1 Credits

The Service may allow users to purchase prepaid digital units ("Credits") that can be redeemed for in‑Service features, enhancements, or access rights. Credits have no monetary value, are not redeemable for cash, and do not constitute currency, property, or financial instruments.

4.2 Purchases

All purchases of Credits or other digital items are sales of non-redeemable virtual goods intended solely for use within the Service. Credits have no monetary value and cannot be exchanged, transferred, or redeemed for cash or cash equivalents.

Purchases are considered fulfilled once Credits are successfully delivered to the user's account. Purchases are generally final; however, refunds, reversals, or chargebacks may be processed where required by applicable law or in accordance with the rules and requirements of the applicable payment processor or card network.

Except as required by law or payment processor rules, the Company does not generally offer discretionary refunds.

4.3 Payment Processing

Payments are processed exclusively by authorized third‑party payment processors. The Company does not store full payment card numbers or sensitive financial data. By initiating a transaction, you authorize the Company and its payment partners to charge your selected payment method for the applicable fees.

4.4 Chargebacks and Disputes

Payments are processed by authorized third-party providers. If you initiate a chargeback or dispute outside of legally required circumstances, we may and are not limited to, suspend or terminate your account and revoke access to the game and related services.

4.5 No Ownership Rights

You acknowledge that all virtual items, Credits, and in‑Service enhancements are licensed, not sold. You acquire no ownership interest in any digital item, regardless of consideration paid.

5. Affiliate Program Terms

5.1 Overview

The Company offers a voluntary, single‑tier Affiliate Program ("Affiliate Program") that allows eligible users to earn commissions when new users they directly refer purchase an Entry Block. Participation in the Affiliate Program is governed by these Terms and any additional guidelines provided by the Company.

5.2 Eligibility

To participate, you must:

• maintain an active Pirate Hunt account in good standing,
• have participated in a natural successful hunt,
• comply with all applicable laws and marketing regulations, and
• submit accurate information during the application process.

Purchasing access does not guarantee affiliate approval or earnings.

Affiliate status is subject to eligibility requirements, gameplay participation and review and approval by the Company.

Affiliate rewards are optional, performance-based and subject to platform terms and withdrawal conditions.

The Company may approve, deny, or revoke Affiliate Program access at its sole discretion.

5.3 Commission Structure

Affiliates earn a one‑time commission when a referred user purchases their first Entry Block.

• Commission rates are determined by the Affiliate's tier level.
• Commissions apply only to the first Entry Block purchased by each referred user.
• No commissions are paid for sign‑ups, self‑referrals, or recruiting other affiliates.
• The Affiliate Program is strictly single‑level; no multi‑tier or downline commissions are offered.

5.4 Payouts

Affiliate rewards are paid only from Company funds and are not tied to pooled user payments.

Commission payouts are issued on the 1st of each month for all approved commissions earned during the previous month.

• Minimum payout threshold: $50
• Payouts are issued via approved payment methods
• The Company may withhold or reverse commissions associated with refunds, chargebacks, or fraudulent activity

5.5 Marketing and Promotion Rules

Affiliates may promote the Service through approved channels, including social media, websites, and personal networks. Affiliates may not:

• engage in misleading, deceptive, or unlawful marketing practices,
• impersonate the Company or misrepresent their relationship with the Company,
• bid on trademarked terms or confusingly similar variations in paid advertising,
• use spam, unsolicited messages, or automated tools to distribute affiliate links.

5.6 Violations and Termination

The Company may suspend or terminate an affiliate's participation for violations of these Terms, fraudulent activity, or conduct deemed harmful to the Company. Suspension or termination may result in forfeiture of unpaid commissions.

6. Sponsored Influencer Program

6.1 Overview

The Sponsored Influencer Program ("Influencer Program") is an invitation‑only promotional initiative for eligible creators who maintain an established presence on approved social media platforms. Participation is discretionary and subject to review and approval by the Company's partnerships team.

6.2 Eligibility and Participation

To be considered for the Influencer Program, participants must:

• maintain an active Pirate Hunt account in good standing,
• possess a minimum audience size as determined by the Company,
• consistently publish content that aligns with the Company's brand and community standards, and
• comply with all applicable advertising, disclosure, and platform‑specific guidelines.

Eligibility does not guarantee selection. Invitations are extended solely at the Company's discretion.

6.3 Deliverables and Compensation

Influencer Program participants may receive a fixed promotional fee in exchange for producing and publishing approved content.

• Compensation amounts, frequency, and deliverable requirements are defined in the participant's individual agreement.
• Compensation is contingent upon timely completion and verification of required deliverables.
• Failure to meet deliverable requirements may result in reduced or withheld payments.

All payments are treated as promotional or contractor compensation and do not constitute commissions or revenue sharing.

6.4 Content Standards

Influencers must ensure that all sponsored content:

• is original, accurate, and compliant with applicable laws,
• includes required disclosures (e.g., "#ad," "sponsored"),
• does not contain misleading claims, offensive material, or unauthorized representations of the Company,
• adheres to any brand guidelines provided by the Company.

The Company may request edits, removals, or clarifications at its discretion.

6.5 Termination

The Company may suspend or terminate an influencer's participation at any time for:

• failure to meet deliverable requirements,
• violation of these Terms or applicable laws,
• conduct deemed harmful to the Company or its reputation.

Termination may result in forfeiture of unpaid promotional fees.

7. Strategic Partner Program

7.1 Overview

The Strategic Partner Program ("Partner Program") is an invitation‑only business development initiative for individuals or organizations that have demonstrated exceptional impact within the Pirate Hunt ecosystem. This program is separate from the Affiliate Program and is not a tier, reward, or extension of affiliate status.

7.2 Selection and Eligibility

Candidates are evaluated by the Company's executive team based on:

• demonstrated performance and contribution,
• professionalism and brand alignment,
• long‑term strategic value,
• overall impact on the platform's growth and community.

There is no application process or published criteria. Selection is made solely at the Company's discretion.

7.3 Partnership Terms

Strategic Partners may receive individually negotiated partnership terms, which may include:

• customized revenue‑share arrangements,
• collaborative opportunities with senior leadership,
• participation in high‑level product and roadmap discussions,
• access to exclusive events, briefings, or partner summits.

All partnership terms are defined in a separate written agreement between the Partner and the Company.

7.4 Limitations

Participation in the Partner Program:

• does not guarantee ongoing compensation,
• does not create an employment relationship,
• does not grant ownership rights or decision‑making authority,
• may be modified or terminated at any time at the Company's discretion.

7.5 Termination

The Company may suspend or terminate a Strategic Partner's participation for any reason, including changes in business needs, violations of these Terms, or conduct deemed harmful to the Company.

8. User Conduct and Acceptable Use

You agree to use the Service in a lawful, respectful, and responsible manner. Prohibited conduct includes, without limitation:

• harassment, threats, or abusive behavior toward other users or Company personnel;
• impersonation of any person or entity;
• uploading or transmitting harmful code, malware, or unauthorized data;
• attempting to gain unauthorized access to systems, accounts, or networks;
• interfering with gameplay integrity, including cheating, exploiting, or manipulating mechanics;
• engaging in activities that violate applicable laws or regulations.

Violation of this section may result in suspension, termination, or other remedial action at the Company's discretion.

9. Intellectual Property Rights

All content, assets, trademarks, graphics, gameplay mechanics, software, and other materials associated with the Service ("Company Materials") are owned by or licensed to the Company and are protected by intellectual property laws. Except for the limited license expressly granted herein, no rights are transferred to you.

You may not reproduce, distribute, publicly display, create derivative works from, or otherwise exploit Company Materials without prior written authorization.

10. Termination

The Company may suspend or terminate your account or access to the Service at any time, with or without notice, for conduct that violates these Terms, poses a security risk, or is otherwise deemed harmful to the Service or its users.

Upon termination:

• your license to use the Service immediately ceases;
• access to Credits, virtual items, and account data may be revoked;
• no refunds or compensation will be provided, except where required by law.

You may terminate your account at any time by discontinuing use of the Service.

11. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, the Company disclaims all warranties, including:

• merchantability,
• fitness for a particular purpose,
• non‑infringement,
• uninterrupted or error‑free operation,
• accuracy or reliability of gameplay or data.

You acknowledge that online services inherently involve risks, including interruptions, delays, data loss, and security vulnerabilities.

12. Limitation of Liability

To the maximum extent permitted by law:

• the Company shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages;
• the Company's aggregate liability arising out of or relating to the Service shall not exceed the total amount paid by you to the Company in the twelve (12) months preceding the event giving rise to the claim;
• the Company is not responsible for losses resulting from unauthorized account access, user error, or third‑party actions;
• Company not liable for injuries arising from participation;
• Subject to applicable law;
• Tied back to Disclaimers.

Some jurisdictions do not allow certain limitations; in such cases, the limitations apply to the fullest extent permitted.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, contractors, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of:

• your use or misuse of the Service,
• your violation of these Terms,
• your violation of any law or third‑party rights.

14. Third‑Party Services

The Service may integrate or interact with third‑party platforms, tools, or services. The Company is not responsible for the availability, functionality, or practices of such third parties. Your interactions with third‑party services are governed solely by their respective terms and policies.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is organized, without regard to conflict‑of‑law principles.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration or other dispute‑resolution mechanisms as designated by the Company, except where prohibited by law.

16. Severability

If any provision of these Terms is deemed invalid, unlawful, or unenforceable, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding the Service and supersede all prior or contemporaneous understandings, communications, or agreements, whether written or oral.
